Conditions for Hiring Goods & Conditions of Sale

All quotations are made and all orders are accepted subject to the following conditions . All other conditions whatsoever are excluded from the contract, or any variation thereof, unless expressly accepted in writing by the Company.

b) These conditions do not affect the Customers rights as a person dealing as a consumer not for business purposes.

c The contract will be governed by English law

2) The Company's Charges
-
a) Charges for hiring goods
-
The Customer must pay the hire charges shown in the contract. Hire charges will start at the time shown in the contract and will continue until:
-
The Company has given the Customer a collection or off hire number; or
-
the Customer has returned the goods to the Company in clean and usable condition and the Company has given the Customer a receipt for them, which ever is earlier
-
Hire charges are due all the time the Customer has the goods including Saturdays, Sundays and public holidays unless the Company has agreed in writing to a suspension of hire. The Customer must pay the charges owed when the ('Company asks for them. This includes the right for the Company to make charges at interim intervals as the Company sees fit, before and up to the completion of the hire period and the right to make similar charges for any item of goods on hire separately where more than one item of goods have been hired within a single purchase order from the customer.

b) Payment terms for buying goods
-
If the Company has agreed in writing to let the Customer have a monthly account, the Customer must pay all the Company's invoices by the last day of the month following the month the goods were delivered. If the customer does not have a monthly account with the Company payment and or a deposit as required by the Company must be made with order or when the goods are delivered if the Company has agreed this with the Customer.

c) Interest and other charges
-
If the Customer does not pay any amount when it is dime, the Company will add interest to the amount that is over due at a rate equal to 4% above Barclays Bank plc's base rate at the time. Charging interest will not affect any other rights the Company may have. The customer must also pay any of the company's reasonable expenses in recovering money or goods.

3) Delivery and collection charges
-
The Customer must pay any agreed charges for delivering or collecting the goods, It the quote includes carriage charges, these only cover the time needed to load or unload rite vehicle at the addresses specified. The Customer must pay extra for any further time caused implementing the Customers instructions for delivering or collecting the goods including failure to do so because of the Customer's acts or failure to do something.

4) Maximum hire period (if the Customer is not company or corporation) If the Customer is not an account Customer the contract will end within two weeks of the beginning of the hire period. If the customer has not already done so he/she must return the goods to the Company on the day before the end of the two weeks period, if the Customer fails to do this, the Company may charge for any financial loss suffered as a result.

5) When the contract starts

The contract comes into effect when an order has been placed and accepted by the Company and will incorporate these conditions,

6) Safety instructions for hired goods
-
The Customer hereby acknowledges receipt of' the safety literature in relation to the goods. The Customer must make sure that everyone who uses the goods is properly instructed on how to use them safely and correctly before operating them and that they have all read and understood the instructions supplied. The customer must make sure the goods are not misused.

7) The Customers responsibility when hiring goods
-
a) The Customer must provide assistance to unload and load the goods at the address specified.
-
b) The Customer becomes responsible for the goods when they receive them if the goods are delivered to the Customer this will be when the Customer's responsibility starts. The customer's responsibilities include protecting the goods and keeping them safe front weather, vandalism or improper use At the end of the hire period the Customer must return the goods unless at arrangements have been made for the Company to collect them, The Customers responsibility does not end until the goods have been returned or collected and the Company is able to give a final receipt for them following inspection at the Company's premises .The customer must not sell or in any way give up control of the goods.

c) When the Customer gives instructions for delivery to or collection from site it is its responsibility to ensure there is a good access to the site and a safe unloading and loading area. The Company in its discretion may refuse to unload or load the goods if either access for unloading or loading areas are unsuitable and the Customer will be responsible for all associated extra costs caused thereby. Further, if the Company arrives at site to deliver or collect the goods and the Company is unable to immediately deliver or collect the goods then the Customer will be liable for:
-
i) Continuation of hire charges.

ii) Any waiting time or additional travelling time occurred by the Company.

The Customer will be responsible for any death,, injury, or loss or damage caused by the goods being misused while they are hired. The Customer is advised to have an appropriate level of insurance in place for such eventualities before collecting the goods.

8) Electrical goods If any part of the goods is electrical, it should be used with the original plugs or sockets fitted to it. If the customer needs to fit other suitable plugs or sockets to the gods. this must be carried out by a competent person who must return the goods in their original condition. The Customer must make sure there is a suitable supply of electricity for the goods. The Customer should never use electrical goods that are not earthed correctly unless the goods are double insulated and must keep to all regulations which apply, including the Electricity at Work Regulations 1989, while responsible for the goods.

Maintaining hired goods. breakdown procedures and reporting accidents The Customer must make sure the goods remain safe, clean and in working order. If the goods break down or are not working properly the Customer must cease their use and report this to the Company immediately. Unless and until such report is made the goods remain on hire at the customer's expense. The Customer must not repair the goods unless authorised by the Company and must return the goods to the Company to examine them unless the Company has agreed otherwise in writing. The customer mast report immediately ii the goods are involved in any accident resulting in damage to the goods or to other property or injury to any pet son and must take all necessary steps to make the goods safe and to protect then against theft or damage.

10) Where hired goods are placed

The hired goods must not be moved from any site agreed by the Company without further written permission from the Company.

II) Limit of the Company's liability
-
a) All the time quoted for delivery or collecting the goods are approximate only.
-
b) The Company will not he liable bar any delays caused by circumstances beyond its reasonable control.
-
C) If the goods breakdown or stop working properly the Company will try to replace them or repair the fault as soon as reasonably possible after it has been reported.
-
d) If the Customer hires or buys the goods for use in a business, the Company will not be liable for any indirect loss or any loss of business or profits or savings expected to be made or wages, fees or expenses caused by the goods or any part of them breaking down or stopping working properly or their failure to be delivered at a certain time.

12) Insurance; payment for hired goods that are lost, stolen or damaged
-
The Customer must pay to the Company the cost of replacing any hired goods which are lost or stolen or damaged beyond economic repair (that is if the repair would cost more than the equipment is worth). The customer must insure the goods for replacement cost and on a 'new for old' basis. if the Customer receives any money as settlement of any claim relating to the damage to or loss or theft of the goods it must hold that money separately in trust for the Company and pay it to the company on demand.

The Customer must not negotiate any claim without the Company's written permission. In such circumstances the goods remain on hire until the Company has agreed payment in full of a sum equal to the replacement cost and all outstanding hire charges

13) Lost, stolen, damaged or unclean hired goods
-
a) The Customer is responsible for looking after the goods and returning them to the Company clean and in good working order.

b) The Customer must pay the Company's reasonable costs of repairing or cleaning the goods if' they are returned unclean or are damaged in any way due to misuse or neglect during the contract.

14) Ending the contract if hired in the course of business The company my end this contract if:
-
a) Customer breaks this contract: or
-
b) if a company, the Customer starts to be wound up or a receiver or administrator is appointed over all or part of its assets: or
-
c) the Customer enters into any agreement with its creditors or a voluntary agreement is made with them: or
-
d) the Customer enters into voluntary arrangement or
-
e) the customer seeks without permission to sub hire the goods
-
If the Company ends the contract in these circumstances, it will end immediately and the Company may repossess any or all of the goods. If the Company ends the contract it will not affect the Company's right to recover any money owed to the Company under this contract or damages claimed as a result of' the customer breaking this contract

15) Ending the contract if hired as a private individual and not in the course of a business.

If the customer is hiring the goods as a private individual and not in the course of a business the company may end this contract if
-
a) The customer breaks this contract; or
-
b) The customer becomes bankrupt, or
-
c) The customer enters into a formal arrangement with his/her creditors (those to whom the customer owes money
-
d) The customer seeks without permission to sub-hire the goods
-
If the Company ends the contract in these circumstances it will calculate the hire charges for time actual period of hire.

16) The Company's rights of access
-
The company may enter any land or premises where it reasonably believes the goods are for the purpose of checking their condition and the methods of their operation by time Customer and may do this at reasonable times with or without notice.

17) Ownership or and responsibility for the goods the Customers buys
-
a) If the Customer buys any equipment from the Company it will become responsible for loss or damage as Soon as the goods are delivered.

b) The company owns the goods until payment in fill has been made for all the goods supplied, until the Company has received full payment for the goods the Customer will hold the goods on the company's behalf and must return them to the company if requested. The company may enter any land or premises other than the Customer's home to recover it's goods.

18) Condition of goods on receipt
-
The customer by its/his/her signature to this contract acknowledges that the Customer has had a reasonable amount of time to inspect the goods before entering into this contract and receipt of the goods in a good and clean condition.

19) Separate terms
-
If any term in this contract cannot be enforced this will not affect the remaining terms.
